The Illinois concealed carry did not acknowledge the hid carry permit of different states. So how can someone who is frequently visiting Illinois, for work or personal reasons, exercise their 2nd Amendment rights?
Although the small-arm hid Carry Act supposed to issue licenses to non-residents, the way the law is interpreted, only residents of Hawaii, New Mexico, South Carolina and Virginia are currently able to obtain them. And that is after paying an application fee of $300, which is twice the fee for residents. Until there’s a legislative “fix” to the law, no different non-residents no one have the capability to get an Illinois permit.
HOWEVER, non-residents who have a valid CCW allow from their own state may have a concealed firearm in their car. By using the definition of the act, this will encompass a loaded handgun in the passenger compartment of their car, but only in their car. So they will “carry concealed” in Illinois among their vehicle
When leaving the vehicle, the gun would have to either be left in the car:
- in a container, and
- either the container or the car itself must be locked
Or, the gun would have to be unloaded and removed from the car.
Interestingly enough, this means that associate Illinois resident does not have a License to carry is guilty of a felony for having a loaded gun in their car, but a non-resident is utterly legal until they have a permit from their own state. Concealed Carry Law- For Non Residents
An Illinois hid carry allow permits someone to possess a loaded or unloaded handgun to be carried. On the person either completely, or mostly, concealed from public view, or On or about the individual inside an automobile and hid from public view. A handgun is any firearm designed to be held and fired from a single hand. It excludes any rifle, shotgun, and machine gun, stun gun/Taser or paintball gun.
The law needs the Illinois State Police to issue a hid carry license to A somebody among ninety days of an application’s submission with attending proof of successful completion of a certified training/education course, and payment of the appropriate fees. The license shall be valid for 5 years and subject to renewal for a like period of 5 years.
Those ineligible for a permit include anyone;
- Under the age of 21,

- Has a court disposition for domestic battery,
- Has any felony conviction,
- Has 2 or more dui abuse within five years of application,

- Has restricted by court order from possessing a firearm,
- has been in residential or court-ordered treatment for alcoholism or drug use within five years of application,
- Has a conviction for custody of cannabis within one year of application,
- Against whom reasonable suspicion exists that they are a threat to public safety, or
- Have five or additional arrests, or three or additional gang-related arrests, at intervals seven years of application
- Places and locations for which concealed carry shall be prohibited include:
- all schools, such as pre-colleges, day-care centers, schools, and universities,
- All government buildings, court facilities, and detention centers,
- Public transportation centers and vehicles if publically funded
- Public controlled parks and athletic facilities,
- Public playgrounds,
- Licensed gambling facilities,
- Any public event requiring a local government permit (i.e. town festival),
- Any public library, zoo, museum, amusement park, or airport,
- Any nuclear facility,
- Any pro or college sporting event,
- Any hospital, nursing home, or mental health facility,
- Any institution who are driving 50% or more of its gross profits from the sale of alcohol,
- Any location if the permit holder is under the influence of alcohol or drugs, and
- Any other Territory at which the private assets owner shall limit concealed carry and post right is aware of such.
All such exclusions include the entire property and parking lots. However, parking heaps area unit exempted if the handgun is concealed on the person while in the vehicle, or placed in a locked container, such as a glove compartment, and out of public view. (Nuclear facilities aren’t covered inside this exemption). All prohibited locations are required to post a sign in a conspicuous area advising the public that firearms are not permitted.
Violations of the hid carry act area unit disciplined as follows:
First offense – class B misdemeanor, (a criminal offense carrying a maximum penalty of 6 months in jail)
Second offense – class A misdemeanor (a criminal offense carrying a maximum penalty of 1 year in jail), and 6-month suspension of permit,
If a person is properly licensed to conceal carry, any violation of the concealed carry act will not subject that person to prosecution for violation of Illinois’ unlawful use of weapon statute. The act additionally permits non-residents of Illinois to get a non-resident’s hid carry allow upon following the appropriate application procedures. It additionally exempts those holding correct hid carry permits from different states to carry a concealed handgun on the person, in a vehicle, while that person is driving through the State of Illinois.
